What Do You Do If Your Employer Forgets to Pay You?

You are a nanny, an employee of an employer-family.  As an employee, you are legally entitled to be paid for your time worked for your employer-family.  What do you do if your employer-family forgets to pay you?

If this is this is the first time that your employer-family has forgotten to pay you, it may be a simple oversight on their part.  Your response should be one of gentle prompting.  For example, you may say, “Was last Friday payday?  I was thinking that it was, but I didn’t receive my check, so I thought, since I’m paid biweekly, maybe I’d recalled incorrectly and payday is actually this Friday.  Is it?”

If this is not the first time that your employer-family has forgotten to pay you, you should try to discern your employer-family’s circumstance.  This should not be done by direct inquiry, because that can create an affront.  Instead, you can usually discern by observation and listening to what your employer-family has to say.  There are many employer-family circumstances that can prompt the accidental or purposeful omission of a paycheck.  For example, if you are the only person employed by your employer-family, perhaps they do not have a system in place to remind them to pay you on paydays.  If your employer-family maintains a hectic pace to their lives, perhaps they have not had time to pay attention to your pay schedule.  If your employer-family is living deeply in debt, they may not have the money to pay you in a timely manner.

Once you have determined what you believe to be your employer-family’s circumstance, you can then decide how you wish to respond to your situation.  For example, if your employer-family lacks a system to remind them to pay you on paydays, perhaps you can remind them of payday the day before each paycheck is due to you, you can write “payday” on the family calendar, etc.  If your employer-family maintains a hectic pace to their lives such that they do not always have the time to pay attention to your pay schedule, you can suggest outsourcing their payroll and accounts payable to an accounting firm or trusted financial advisor; or you can remind them of payday the day before each paycheck is due to you, you can write “payday” on the family calendar, etc.  If your employer-family is living on the financial razor’s edge, you must decide if you can afford to remain employed by an employer-family that may not be able to fulfill their financial obligations to you.

By following the tips above, you can handle the situation constructively when your employer-family forgets to pay you.
